New workplace delegate and health and safety representative rights

There have been changes to workplace delegates’ rights as part of the Closing Loopholes amendments to the Fair Work Act. Similarly, the Queensland Work Health and Safety and Other Legislation Amendment Act recently made changes to the powers and functions of Health and Safety Representatives. In many workplaces, these are the same person or people.

To avoid unnecessary disputes and support collaborative and harmonious workplaces, it is important that there is a shared understanding and expectation regarding the interaction between delegates, officials, health and safety representatives, health and safety committees and the workplace. This seminar explores the new rights, powers and functions of these roles and the responsibility and obligations of workplaces.

Troy Spence LLB (Hons)

Troy Spence has a diverse practise with a focus employment and industrial relations, work health and safety and crime. Troy has extensive experience in dispute resolution, agreement negotiation, corporate governance, and public administration.

Since being called to the bar in 2018, Troy has appeared, both led and unled, in appeals before the Full Federal Court, the Queensland Court of Appeal, the Industrial Court of Queensland and Full Benches of both the Fair Work Commission and the Queensland Industrial Relations Commission.

Prior to being called to the Bar, Troy worked for 18 years in both public sector and private sector industrial relations appearing in the Queensland Industrial Relations Commission and the Fair Work Commission. During this time, he also negotiated a significant number of Enterprise Agreements including leading negotiations for project greenfield agreements for major civil construction projects throughout Queensland and the Northern Territory.

Troy is a graduate of the Australian Institute of Company Directors and holds a Diploma in Superannuation. Troy has previously been a Director and Board member for a number of organisations including being the inaugural Chair of the Australian Super Queensland Advisory Board which was established after the successful merger of the Aust Q Superannuation fund and Australian Super in 2014.

Troy was ranked as Leading Junior Counsel in Doyles in the 2024 listing of leading Queensland Employment & WHS Barristers.
